Terms of Service

1. Acceptance

By signing in to Eleven9s, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not sign in. You can stop using the service at any time by deleting your account from Settings.

2. Your content, your rights

You own your photos, videos, and audio. Uploading them to Eleven9s does not transfer ownership. You grant us a narrow, revocable license to store your files and return them to you on request — nothing more. We do not license your content to third parties, use it to train anything, or display it outside your own account.

3. Acceptable use

You agree not to use Eleven9s to:

• Store, transmit, or share content that is illegal under the laws that apply to you or to us — including child sexual abuse material, fraud proceeds, material that infringes intellectual property, or material subject to an active sanctions regime.
• Attempt to probe, scan, or compromise the service, or to interfere with another user's access.
• Resell the service, or expose Eleven9s-generated URLs or signing cookies to other parties.
• Use the service in a manner that would cause us to violate U.S. sanctions, export controls, or laws applicable to our subprocessors.

We cooperate with lawful government requests and reserve the right to suspend or terminate access for violations of this section. We aim to give you notice before suspending where possible; in any case we will provide an export of your content on request (subject to the same laws).

4. Subscriptions and payment

Eleven9s offers a free trial followed by a paid subscription billed through Apple's in-app purchase system. Apple handles all payment processing, refunds, tax, and local availability; we never see your payment card or bank details. Subscriptions auto-renew until you cancel.

To cancel, change, or request a refund, use iOS Settings → your Apple ID → Subscriptions, or contact Apple Support. Your access continues through the end of the current billing period; we do not prorate partial periods.

If your subscription lapses, we keep your content in a read-only state for 30 days so you can export or re-subscribe. After 30 days we begin deletion with 7 days of email warning. This timeline is described in the Privacy Policy and in our product documentation.

5. Service availability

We make a best effort to keep Eleven9s available and your data safe. We rely on AWS S3 for storage, which is designed for 99.999999999% (11 nines) of annual object durability. We do not, however, offer a formal uptime SLA in v1. Planned maintenance and unplanned outages will happen; we will make them as brief and transparent as we can.

6. Termination

You can delete your account at any time from Settings → Delete Account. Your data is purged within 24 hours (see Privacy Policy for specifics).

We can terminate or suspend your account for violations of Section 3, for non-payment of subscription fees, or for reasons required by law. Except in cases of suspected illegal content or an active legal process, we will give you at least 7 days' notice and an opportunity to export your data.

7. Disclaimers

Eleven9s is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability to you under these Terms is limited to the total subscription fees you paid to Apple for Eleven9s during the twelve (12) months immediately preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

9. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws principles. Any dispute not subject to Apple's dispute terms shall be resolved in the state or federal courts located in the State of Colorado, and you consent to personal jurisdiction there.

10. Changes to these Terms

Non-material changes take effect on publication. Material changes (reducing your rights, changing fees beyond the subscription product, or changing dispute resolution) get at least 30 days' notice via push notification or email before they take effect; continued use after the effective date constitutes acceptance.
